BEN CLARK INTERVIEW

When I was a new yoga teacher, I dreamed of leading retreats. Now, 15 years later, I’ve led many, but in my law practice for yoga professionals, I see so many gifted teachers leave their legal protection to chance. Don’t let that be you! Follow my top tips to ensure your next retreat is a success, free from legal headaches.

1. Use a Retreat-Specific Participation Agreement.
Your regular class waiver won’t cut it. Use a professional agreement addressing travel and yoga risks, including a liability release, third-party disclaimers, and conduct rules. It’s your legal shield, so get it signed before any payment is made.

2. Clarify Your Terms and Conditions.
Your T&C is the business roadmap. It must detail costs, what’s included versus excluded, and a firm cancellation/refund policy. This prevents misunderstandings and provides a clear path for resolving disputes before they start.

3. Secure Comprehensive Insurance.
One policy isn’t enough. Secure General Liability for accidents, Professional Liability for teaching-related claims, and cyber for data and online protection. Ensure your coverage follows you abroad and require participants to buy their own travel insurance.

4. Create a Liability Shield.
Operating as a sole proprietor leaves your personal assets exposed. Form an LLC or corporation to create a crucial liability shield and establish yourself as a legitimate business. Be sure to properly maintain your company by keeping business and personal finances separate and having your corporate records in place and up to date.

5. Market Mindfully and Plan Diligently.
Market your retreat with accuracy and avoid exaggerated claims to manage expectations and strengthen your legal rights. As you promote your retreat, protect yourself by getting written permission before using participant photos and consider trademarking your brand as you grow. Finally, diligent operational planning is essential. Carefully vet all your vendors and activities, and be prepared for emergencies. This foresight, in addition to visioning a successful retreat, protects your business and ensures a smoother, safer experience for everyone.
